Is Uhaul responsible for the damage to my car? Two weeks ago I went to a local Uhaul lot and rented one of their uhaul trucks. After signing all the paperwork and before taking off in the...

Oh where to begin…When I got the U-haul trailer, it was very rickety. They assured me it was fine and the hitch was secure. So, trusting that they knew what they were talking about, I loaded the trailer with my life belongings. As we loaded the trailer, it creaked and rattled. I kept wondering if we should have taken it back for another one, but we were already behind schedule. We had to reload the stuff 3 times because we couldn’t get it to “level out.” We did follow the guidelines posted on the interior of the trailer on where to place heavy items. My neighbor made me shudder as he said, I don’t think its gonna make it across the country. I assured him that the U-haul company said it was fine. I should have listened to my neighbor. He is a mechanic.

Less than 250 miles from our departure when tragedy struck. Mind you, we were on a cross country trip from CA to the East Coast. The trailer began to shimmy all over the road. The more I tried to control it, the more out of control it got. Then it took our van with it for the ride of my life. The trailer hitch on the U-haul broke off, breaking the brake cable that is supposed to stop the trailer in an emergency. We spun, we swerved, we did 8’s all over the road. We finally came to a stop when we hit the rail at 35 mph head on. I had tried to brake to a slower speed, but the trailer did not want to cooperate.

Lucky for us, there were witnesses behind us on the road and one called 911 right away. EMS whisked my kids off to the emergency room in Reno. After I secured my cats in a witnesses car, I agreed to be taken to the hospital too. I couldn’t very well leave them in a doorless van on a desert interstate highway in July.

One of my cats freaked out during the entire ordeal and ended up bolting from the nice man that took them to safely. We never did find him.

We are still having medical problems from the accident 2 months later. Our van was totaled (over $10K in damage). My furniture was damaged, some beyond repair. Just to get my things from the trailer, the salvage yard people had to litterally pry the door off using a forklift and a truck pulley.

They never even offered to give me my money back for the trailer when it never made it the 3500 miles it was rented for. Can we say breach of contract??

We ended up stuck in Reno Nevada for a week waiting for family to help find us other transportation to the East Coast. It would not have been so bad, but it was during Hot August Nights when hotels were outrageous in price. While I stayed in the hotel, I met another woman stuck there because her U-haul truck lost its wheels while she was driving!

To add insult on injury, the same day that U-Haul’s insurance said they looked at their trailer and that they were not responsible, I received a letter from their CA store asking me where the trailer is located. Hum, isn’t it in the salvage lot they towed it to??

By the way, my insurance company (Geico) said that I am not responsible and if I wasn’t a better driver, my children and I would be dead now.
