Ok, so last week my roommate and I rented a UHaul to move. The Uhaul was rented under my name. We did not add an additional driver and we did NOT take the insurance. Later that night I was not feeling well so my roommate drove. As luck or fate would have it we got in a very low speed (20mph) accident with another car for illegal passed us on the right on a 2 lane road. We called the police and filed a report. The officers made it clear that the other car was at fault, not us. No damage was made to the UHaul but there was a scratch and a small dent on the rear of the other car. Now this other driver, who was at fault, is contacting my roommate for damages. My roommate contacted his insurance about the accident. Now my roommates insurance wants my information. What I want to know is who is responsible? We weren’t at fault, my roommate was driving, but it was registered to me. We didn’t have insurance on the Uhaul. My roommate only has liability. I have comp. thanks

First of all, do not let the other party who passed you on the right intimadate you into thinking that you are liable for damages. He was clearly at fault. When you rented the Uhaul it is usually covered under your own personal car insurance policy and if you gave your friend permission to drive, then he is covered under your policy also. Make sure you get a copy of the police report. Always make sure you contact your insurance company to let them know you are renting a vehicle for personal use.
